Terms of Service

1. Definitions

  • 1.1. “Applicable Laws” refers to all statutes, regulations, ordinances, treaties, judicial decisions, and directives issued by governmental authorities in India or other jurisdictions, as relevant to users.
  • 1.2. “Bank Account” means a financial account held with a banking institution or an RBI-authorized entity, including digital wallets.
  • 1.3. “Banking Company” is defined under Section 5(c) of the Banking Regulation Act, 1949.
  • 1.4. “Barred States” refers to Indian states where online gaming is prohibited by law.
  • 1.5. “Buy-in” denotes the monetary amount required to enter a Cash Game.
  • 1.6. “Buy-In Balance” represents the total funds available to a user for participating in Cash Games.
  • 1.7. “Cash Games” are games involving financial stakes determined by participants in accordance with Game Rules.
  • 1.8. “Communication Feature” enables in-game interaction between users.
  • 1.9. “Deposit Balance Segment” is the wallet section where deposited funds (after GST deductions) are credited.
  • 1.10. “Discounted Buy-in Value” refers to the actual amount debited from a user’s wallet for Cash Games, irrespective of the game’s nominal Buy-in.
  • 1.11. “Discount Credits” are non-monetary promotional credits issued at the Platform’s discretion. They are non-transferable, non-withdrawable, and time-bound.
  • 1.12. “Discount Credit Segment” displays the balance of non-monetary credits in the user’s wallet.
  • 1.13. “Games” include all Rummy formats (points, deals, pool, tournaments) offered on the Platform.
  • 1.14. “Game Balance Segment” reflects funds available for Cash Games.
  • 1.15. “Game Rules” are the rules specific to each Game, accessible on the Platform.
  • 1.16. “Platform” comprises the BestRummyinIndia website, mobile apps, and related services.
  • 1.17. “Platform Policies” encompass these Terms, Privacy Policy, Fair Play Policy, and Game Rules.
  • 1.18. “Platform Charge” is the fee levied for using services, applicable during deposits, withdrawals, or both.
  • 1.19. “RC Account” is the user account required to access Games.
  • 1.20. “Refund” refers to the reversal of unused deposits (excluding GST) to the user’s wallet.
  • 1.21. “Terms” means these Terms of Service.
  • 1.22. “RC Wallet” is the user’s wallet for managing funds on the Platform.
  • 1.23. “Withdrawable Balance” denotes funds eligible for transfer to a Bank Account.
  • 1.24. “Withdrawal” is the process of transferring Withdrawable Balance to a designated Bank Account.
  • 1.25. “Withdrawal Request” is a formal request submitted by the user to initiate a withdrawal.
  • 1.26. “Withdrawable Balance Segment” is the wallet section where Cash Game winnings are credited.

2. Eligibility

  • 2.1. The Services are prohibited for:
    • Individuals under 18 years of age.
    • Users accessing the Platform from Barred States.
  • 2.2. BestRummyinIndia reserves the right to:
    • Request age and geolocation verification.
    • Restrict access if violations are suspected.
  • 2.3. Participation in Cash Games is prohibited if the user:
    • Lacks legal capacity to transact in INR via banking channels.
    • Resides in or accesses the Platform from a Barred State.
  • 2.4. Breaches of these Terms may result in account termination and forfeiture of winnings.

3. Use of Services

  • 3.1. Games are accessible via mobile apps downloadable from BestRummyinIndia’s website, Google Play, App Store, or other sources.
  • 3.2. Rummy is recognized as a skill-based game, legal in most Indian states.
  • 3.3. Fair play is ensured through a Random Number Generator (RNG) certified by iTech Labs (ISO 18925).
  • 3.4. User data is processed per the Privacy Policy.
  • 3.5. Registration requires mobile number verification.
  • 3.6. Users consent to receive promotional communications. Opt-out requests must be emailed to support@BestRummyinIndia.com.
  • 3.7. The Platform is not liable for user-side technical issues (e.g., connectivity, device errors).
  • 3.8. Winnings and Discount Credits are non-transferable. Unauthorized transfers will result in forfeiture.

4. Account Registration

  • 4.1. Registration requires a valid phone number. Multiple accounts are prohibited.
  • 4.2. Usernames must not violate public morality, intellectual property rights, or promote advertising.

5. Game Formats and Rules

  • 5.1. The Platform offers Cash and non-Cash Games. Game formats may be modified at the Platform’s discretion.
  • 5.2. Users must comply with Game Rules, accessible via the “See Rules” option on the Platform.
  • 5.3. Newly introduced Games are governed by the Platform Policies.
  • 5.4. Game outcomes are final and determined by the Platform’s systems.
  • 5.5. In case of discrepancies between Game Rules/FAQs and these Terms, the Terms prevail.
  • 5.6. Prizes are subject to specific terms communicated at the time of issuance.

6. Restrictions

  • 6.1. Users are prohibited from uploading, sharing, or displaying content that:
    • Infringes intellectual property, privacy, or public morality.
    • Promotes illegal activities, hate speech, discrimination, or misinformation.
    • Contains viruses, malware, or disrupts Platform functionality.
    • Impersonates others or misleads about identity.
    • Violates national security, public order, or applicable laws.
  • 6.2. Violations may lead to immediate suspension of Communication Features or account termination.
  • 6.3. Reverse engineering, unauthorized server connections, or commercial use of the Platform is strictly prohibited.
  • 6.4. Users may not transfer, sell, or lease accounts, in-game assets, or winnings.
  • 6.5. Fraudulent activities (e.g., using stolen payment methods) will result in account termination and legal action.
  • 6.6. Employees of BestRummyinIndia and their relatives are barred from Cash Games with monetary prizes.

7. Deposits, Withdrawals, and Refunds

  • 7.1. Deposits
    • Funds are credited to the Deposit Balance Segment after GST deductions.
    • Maximum deposit per transaction: ₹50,000.
    • GST-compliant invoices are available in the RC Wallet.
  • 7.2. Withdrawals
    • Minimum withdrawal: ₹100; maximum: ₹1,00,000 per transaction.
    • Platform Charges may apply, varying based on user engagement.
    • Withdrawal Requests require KYC verification.
  • 7.3. Refunds
    • Unused deposits may be refunded within 180 days (GST non-refundable).
    • Refunds are processed to the original payment source.

8. KYC Verification

  • 8.1. KYC is mandatory for:
    • Withdrawal Requests.
    • Suspected Policy violations.
    • Promotional offers or winnings.
  • 8.2. Users must submit valid PAN and Bank Account details via the Platform.
  • 8.3. KYC validation takes up to 3 working days.

9. Discount Credits

  • 9.1. Issued at the Platform’s discretion for deposits, withdrawals, or promotions.
  • 9.2. Expiry dates and usage terms vary per offer.
  • 9.3. Credits are forfeited upon account termination or Policy violations.

10. Taxes

  • 10.1. TDS (30%) is deducted on net winnings:
    • At the time of withdrawal.
    • At the end of the financial year (April 1–March 31).
  • 10.2. PAN must be Aadhaar-linked and valid. Non-compliant users lose TDS credits.

11. Termination, Suspension, and Opt-out

  • 11.1. Inactive Accounts
    • Accounts unused for 12 consecutive months may incur an annual maintenance fee of up to ₹250.
    • GST-compliant invoices will be issued for such charges.
  • 11.2. Account Termination
    • BestRummyinIndia reserves the right to suspend/terminate accounts for Policy violations.
    • Funds in the Withdrawable Balance may still be withdrawn post-termination.
  • 11.3. Post-Termination Access
    • Users cannot reuse linked mobile numbers, PAN, or Bank Accounts for new registrations.
  • 11.4. Security Breaches
    • Remedial actions for breaches include permanent bans, withdrawal restrictions, and legal claims for damages.
  • 11.5. Fair Play Violations
    • Includes collusion, money laundering, or manipulating game outcomes.
    • Penalties: Fund forfeiture, compensation fees (up to ₹10,000 per violation), and account freezing for 180 days.
  • 11.6. Government Directives
    • Accounts may be suspended, and funds redirected per law enforcement instructions.
  • 11.7. Account Validation
    • Failed validation attempts may restrict access until verification is completed.
  • 11.8. Voluntary Deletion
    • Users may request account deletion via email. A closure fee (up to ₹1,000 or 10% of balance) applies.

12. User Representations and Warranties

  • 12.1. Users warrant that:
    • They are legally competent to enter agreements.
    • Provided information is accurate and updated.
    • They will not share account credentials or engage in unlawful activities.
    • They accept financial risks associated with Cash Games.
    • Winnings depend on skill and game outcomes, not Platform guarantees.

13. Content and Advertisements

  • 13.1. User-Generated Content
    • Users grant BestRummyinIndia a perpetual, royalty-free license to use their content for marketing.
  • 13.2. Third-Party Content
    • The Platform is not liable for offensive or unlawful content posted by others.
  • 13.3. Sponsored Content
    • Promoted links or ads are third-party responsibilities. Interaction is at the user’s risk.
  • 13.4. Gameplay Recordings
    • The Platform may use gameplay recordings for corporate or promotional purposes.

14. Disclaimer and Liability

  • 14.1. No Liability
    • The Platform is not liable for financial losses, damages, or lost winnings arising from Service use.
  • 14.2. Liability Cap
    • Maximum liability (excluding valid withdrawals) is limited to Platform Charges paid in the preceding 3 months.
  • 14.3. Indemnification
    • Users indemnify BestRummyinIndia against claims related to their use of the Services.
  • 14.4. No Warranty
    • Services are provided “as-is.” Implied warranties (merchantability, fitness) are disclaimed.
  • 14.5. Third-Party Interactions
    • The Platform disclaims responsibility for disputes with third parties or user-generated content.

15. Intellectual Property

  • 15.1. Ownership
    • All Platform IP (software, trademarks, content) is owned by BestRummyinIndia.
  • 15.2. Limited License
    • Users receive a non-exclusive, revocable license to access Services per Platform Policies.

16. Complaints and Disputes

  • 16.1. Grievance Redressal

  • 16.2. Confidentiality
    • Dispute resolutions and Platform decisions are binding and confidential.

17. Governing Law and Dispute Resolution

  • 17.1. Jurisdiction
    • Disputes are governed by Indian law and subject to Bengaluru courts’ exclusive jurisdiction.
  • 17.2. Arbitration
    • Unresolved disputes within 30 days are referred to a three-arbitrator tribunal in Bengaluru (Arbitration Act, 1996).
  • 17.3. Interim Relief
    • The Platform may seek injunctive relief during pending disputes.

18. Responsible Gaming

  • Users are advised to follow Responsible Gaming guidelines to ensure safe and healthy gameplay.
